2. "Who specifically would do the work on my project, and can I meet them on the first call?"
You're not buying the partner who pitches you. You're buying whoever actually writes the code. If the agency can't produce that person in the first conversation, the actual delivery team is somewhere downstream of where you think it is.
3. "Tell me about an AI project you shipped that didn't work the first time, and what you learned."
Real production AI work involves failure. An agency with no failure stories has either never shipped or won't admit it. Both are problems.
4. "How do you evaluate AI quality in your projects?"
The honest answer involves eval pipelines, representative inputs, regression detection, and domain expert involvement. The hand-wavy answer involves "rigorous testing." Listen to which one you get.
5. "What's your stack-agnostic position?"
A serious AI shop should be model-agnostic, framework-agnostic, and willing to recommend skipping AI for cases where it isn't needed. If everything is the same architecture and the same provider regardless of use case, that's a tell.
6. "How do you handle prompt injection, hallucination, and refusal?"
These are concrete questions with concrete answers. If the agency can't talk about them coherently in your first call, they haven't shipped a real public-facing AI product.
7. "Who owns the code, the prompts, the eval data, and the models after delivery?"
You should. Beware platform lock-in, proprietary "AI orchestration layers" you can't take with you, and "model-as-a-service" arrangements that mean the work doesn't transfer if the engagement ends.
Red flags worth taking seriously
A pattern-level checklist of things that tend to predict bad outcomes:
- No live products. No URLs, no demos that work, only "case studies" that turn out to be deck art.
- "We partner with OpenAI" as a credential. Anyone can have an OpenAI account.
- Vague case studies without technical specifics. "We built an AI-powered platform for a leading bank" tells you nothing.
- Senior on the pitch, juniors on the project. Standard agency-pattern that AI specifically can't survive.

The AI agency market is full of people who can build a great prototype. The market of people who can ship one — keep it running, evolve it without regression, debug it under load, and not embarrass you in front of users — is much smaller.
The discipline isn't just engineering; it's the wrapping. - GDPR + UK Data Protection Act. Real for anything customer-facing. Make sure the agency understands data residency, lawful bases, data processor obligations, and the things your DPO will ask about.
- EU AI Act exposure. If your product touches the EU market, your AI system may fall under high-risk classification with compliance obligations. The agency should know what category you're likely in.
- IP protection. A UK Ltd contractor with a UK contract and English law jurisdiction is materially easier to deal with than an offshore arrangement when something goes wrong. Worth paying for.
